Can H1 visa do Quixtar Business?

Part 1

I had few prospects in states on something like H1 Visa. I asked my upline that can people in H1 do Quixtar business? He emailed "Yeah, many in his team are on H1".

Now, as I don't trust him any more, I mailed Quixtar and asked them the same question. They basically said:
"If a Non-Resident is not traveling to the United States, there are no visa requirements. If a Non-Resident is traveling to the United States, the visa must allow him/her to own and operate an Independent business."
And
"Please have the prospect in question contact the local immigration office to see if he/she meets the current requirements to own and operate a business in the United States."
Pretty logical. I want to share it so every body knows.

Now, my question is still un-answered. I know that I have to ask the right office, as Quixtar don't handle immigration. I'll research on it and post here in Part 2.

The more I'm learning the rules of Quixtar, the more I'm wondering why they are not enforced?

Hi Imran , I went thru the same process and after calling quixtar called Immigration Office and they said that on H1B visa I can not do any part-time business as it would mean I am doing self-employment which means I am competing against the US work-force which I am not suppose to do as H1B visa holder.

This is a huge scandal as many h1 holders are actively building a business which is illegal. Also these people are claiming tax breaks for this illegal business.

Before joining quixtar on h1b We had specifically asked the sponser and direct and they has said that 100% legal and they have so man h1b visa holders doing the business.

Also check-out following where diamond Raj Shaw (Shah) has been interviewed it has been shown that quixtar has been built by hard-working immigrants on a temporary visa.

Hi Imran,

I forgot to mention this in my earlier note so here it is.

After learning from Immigation Deptt. that H1 visa holders can not business/self-employment, I called Quixtar and I was forwarded to Rules Admin deptt. I spoke to one of the Rules Administrator lady and mentioned to her that many H1 holders are doing the illeagal quixtar business and uplines are not telling the truth and deceiving many people. I asked her if she can escalate it within quixtar ranks so that then can issue a warning notice. She gave a confident answer that Yes she will inform the concerned people.

I dont know what happened and whether she really escalated this matter or not. Also it is not known whether any action was taken by the concerned people in Quixtar. So far I have not seen updates on the internet in this regards which means most probably nothing has been done about this issue.

I will probably do a follow-up with Quixtar rules deptt. and let u know the update.

I think we should try to advertise this issue to as many people as possible so that immigrants can be saved from the clutches of bww/quixtar heavy-hitters.

I appreciate your courage and salute your efforts as you are the only south asian who is trying to expose the bww/quixtar crimes. As such we see a lot of law-suites and internet sites by American victims of quixtar and its motivational organizations whereas the most of the indian/south asian victims of bww/quixtar have kept the silence and avoided the direct conflict. This has only emboldened bww indian leaders.

Thanks buddy for the links and kind words. Yes I see so many naive immigrants fell for this scam as they have never heard the "A" word. Also, I have seen many rules violated.

If ppl are told honestly what is the real cost of this business, 70% sales rule, visa status requirement, BSMAA return policy, real life income examples, its not a bad business.

Only if quixtar is run by its rules, and enforces its rule, I won't have a problem. But the lies and deception is all I saw.

It sucks to rip off the immigrants who are already struggling to settle in a new country.

Thanks Imran for your comment on my blog in MSN spaces. I personally know a number of indians wjho are on H1 and are IBO's. I am a PhD student and had the good sense not to join this scam. However, i always wondered how these bastards got off the IRS hook. I am actually considering reporting this to the IRS as a tax scam. The only problem is locating these individuals. I wonder what the IRS will do if i cannot provide them specific leads. However, i know this thing runs deep in the community and i don't like it. It deprives people who really want to be here for H1's and allows greedy individuals to be an IBO or whatever it is called.

In consulting with immigration and immigration lawyers, I have learned that the Quixtar business is legal for H1 visa holders.

The self-employment rule is there to protect the H1 holder's employer. As an H1, you may not do consulting or outside work which could compete with your employer's business. ie. An electrical engineer could not do engineering work or consulting on the outside because it would compete with their employer who paid much money to sponsor them.

H1 has different clauses. For some one it's no-no. Other, lawyer would always recommend to don't do any such think specially since 9/11, INS looks for very minor stuff to not process your application for green card.

Upto you, if you have any desire to go for a green card or get booted for something as minor as having an IBO ship.

Let me see if I can get interview of an immigration lawyer on this issue.

I am an Immigration Lawyer based in Phoenix , AZ, practicing law for more than 10 years. It is 100% legal for anybody who is in temporary work permit to do any network marketing business. Another fact is that you don’t even need to be in USA to build a business in USA, you need VISA only to visit USA or reside in USA, you don’t need a VISA to own a business in USA.

There are several thousand people in temp work permit (like H1, L1) build different network marketing business. They also file their Tax return showing their business expense and income.

Every year I file several dozen Green card (I-485) applications where applicant owns some type of network marketing business. If there is any risk or grey area I would have advised my Clients.

I visited this blog since couple of my clients emailed me with this link and asked me for clarification. So I thought I will post my response here, so that it may help for those who are ambitious about owning a business while working on L1/H1 visa. (also may save my time, responding to such emails from my clients.. hopefully)

How do we receive the income from this business ? my attorney told me I should not receive any income other than my W2, divideds on stocks and interest from bank while I am on H1B. Can you explan?

Apart from the H1 issue, I think the whole thing just sucks. I am sure there are many like me who just hate those good samaritan like indians who appraoch you at grocery stores and other places only with the intention of trying to recruit you into their scheme.

More importantly, these people are targeting individuals who have very little idea of what they are getting into - students without funding especially. I have had many of my friends fall prey to this. I wish they had access to more information before they could make a good decision about whether to join such a scheme or not. In fact the FTC and IRS are both investigating Quixtar businesses for predatory practices such as this.

I advise all potential Quixtar aspirants to think about it before they jump into this business. I am sure they will lose friends, well-wishers and all that is good and nice. If they are lucky they will end up with a reasonable bank balance, even that is questionable.

It really baffles me why people have such negative thoughts across a business which empowers people. I have seen both sides of the coin and for sure the system works, provided you are willing to make it work for you. Why do people feel that you are dragged into this and its a scam? Probably because the people who are making you think that way behave in similar fashion. But this does not prove that Amway is illegal. If it was it wouldn't have existed for 5 decades, especially in the US. This point was rightly pointed out by someone in this thread and thus I wanted to re-iterate the same. Guys, Amway provides an opportunity to do what you want to, however it is upto you how you want to drive this opportunity. So let's not point fingers to someone else before you see what you are doing.

The most intelligent people on this earth do jobs. Work for some body who is not that intelligent. To become successful you don't need intelligent, you need belief in yourself. Amway and it's education system gives you that belief. So that you can become successful. The question about whether the Amway business is legal or not, legitimate or not, do people really make money or not are childish question. Grown man don't ask these question. They already know. The reason people are talking negative because they don't belief that they can be successful, now as a human being it is very hard to blame ourself for our action and circumstances we tend to blame some one or something.

Amway/Quickstar is an illegal pyramid scheme. When you register as an IBO, you sign a document which says you will give up the right go to the court, an arbitrator will decide your fate internally in Amway/Quickstar. This is the first indication that it is illegal pyramid scheme. Second, if you google you will find tons of cases against Amway/Quickstar and Amway lost. You guys are talking about greatness of IBO's and Amway/Quickstar, ask your upline/Diamond to show their expense report and their income and also ask them for Bank Account Statement a) they will not provide you anything other than their Paycheck from Amway/Quickstar b) they will not show you their bank account statements. All the Quickstar IBO members who are millionaires (dimonds, double diamonds etc) they have other businesses that drive money and not just Quickstar. You can calculate the total by yourself ask your upline/diamond. You will have to work even harder to just maintain the diamond level as people below you keep quitting and you will have to keep recruiting. Also, if one of your downline is doing great someone up that is higher in chain will snatch away your downline and you will not be able to drag them in the court. Non-Immigrant Visa Holders CANNOT WORK FOR AMWAY PERIOD.
